Career Experience
Lynn has been working in the legal field since 1976 and has been practising law for 18 years.
Lynn has acted for vendors, purchasers, developers and financiers of commercial and residential properties, offering her extensive knowledge in all aspects of the acquisition, sale and development of real estate. Her work on behalf of financial institutions has focused on the financing of commercial and development properties and mortgage default remedies. She also carries on a corporate practice.
Since 1992, Lynn has acted as counsel on real estate matters to The Metropolitan Toronto School Board, Toronto District School Board, Grand & Toy (Boise Cascade Company), Burger King Restaurants of Canada, Rabba Fine Foods and InterRent International Properties Inc.
Real Estate Transactions
Lynn has acted on behalf of clients from both the public and private sectors, in all areas of real estate, including:
- purchase and sale of residential, industrial and commercial properties, such as retail buildings, shopping centres, condominiums and hotels
- acquisition of properties by school boards
- acquisition, development and construction financing of residential, industrial and commercial properties on behalf of borrowers and financial institutions
- mortgage default remedies, such as powers of sale and negotiation of refinancings, on behalf of financial institutions and private lenders
- land assemblies for school boards and developers
- negotiation of title insurance policies
- formulation and implementation of processes for procuring and managing the title history for a portfolio of 865 properties, including development of a legal information data base for inclusion in a capital assets electronic data base maintained by the client
- transfer of properties by school boards required under amalgamation legislation
Planning and Development
Lynn has broad experience in property development, including purchase of raw land, acquisition financing, negotiating with municipalities and utility companies, registration of plans of subdivision, drafting of sale agreements, construction financing, and final sale of newly constructed homes. She is therefore conversant with all facets of the process, including:
- registration of plans of subdivision
- minor variance applications
- severance applications
- easement agreements
- development agreements
- subdivision agreements
- site servicing agreements
- cost sharing agreements
- shared facility agreements
- participation agreements
- road closings and widenings and land exchanges
Contracts
As counsel to both private and public sector clients, Lynn has broad experience in contractual matters, including:
- construction contracts
- contracts with various service providers, ranging from transportation of pupils to delivery of natural gas
- equipment and property leases
- consulting contracts
- fiscal agent contracts
- confidentiality agreements
- negotiation, mediation and arbitration of disputes
